All students enrolled in any chemistry or biochemistry lab must complete this form at the beginning of each semester for every lab they attend.

This form serves as a release from liability for the university by you, the student, agreeing to practice safety in all laboratory classes and understanding the risks associated of working with chemicals. By completing this form, you, the student, agree not to hold the department or the university liable for any exposure or contact with chemicals.

The financial responsibility portion of this agreement states that if you, the student, loses, breaks, or fails to clean equipment properly, will accept any charges associated and they will be placed as holds on your student account until the university has received payment for these charges.

Release and Indemnity Agreement

I HAVE BEEN INSTRUCTED ON AND UNDERSTAND:

  • All Covid-19 regulations established by the University
  • The safe and proper use of all equipment in the laboratory
  • That I will be working with chemicals that could be irritating or hazardous with excessive exposure.
  • That individuals with sensitive medical conditions should take precautions such as wearing additional protective garments, delaying enrollment or not enrolling in this course at all
  • That women who are pregnant or may become pregnant should consult their physician before enrolling in this course
  • That a list of chemicals used in this course and information about how to obtain Material Safety Data Sheets (MSDS) are available in the Chemistry and Biochemistry Stockroom (CHEM 249)
  • The steps I should take to protect myself and others from unnecessary exposure to the risk of injury or property damage
  • The steps I should take if an injury occurs to me or to another person in the laboratory or if equipment malfunctions.

I UNDERSTAND THAT:

  • I am responsible for my own actions at all times when using the laboratory.
  • I must wear appropriate attire and use all necessary personal protective equipment (PPE) at all times.
  • That I wear CONTACT LENSES AT MY OWN RISK in the lab and understand the risks involved with wearing contact lenses inside the lab.
  • Risks and hazards are present when I use the laboratory, especially when I use the laboratory outside of class time or when the laboratory is not supervised.
  • When I use the laboratory when it is not supervised I do so voluntarily and assume full responsibility for property damage or injury that I may sustain while using the laboratory.

Releasees: The Board of Regents, Texas State University System, Texas State University – San Marcos, and all regents, employees, and agents for these entities.

Release: In consideration for allowing me to use the laboratory, I release, discharge and agree not to sue the Releasees for any claims or causes of action arising from any property loss or injury I may sustain, whether or not caused by any of the Releasees, while using the laboratory.

Indeminity: I also agree to indemnify the Releasees and hold them harmless from any loss, liability or costs they may incur due to my use of the laboratory. For example, I specifically agree to indemnify the Releasees if I injure another person or damage another person’s property while using the laboratory.

Free Act: I have read this form and I understand it. I am submitting it voluntarily, intending to be bound by it.

Student Acceptance of Financial Responsibility Agreement

Section 1 – Lab Courses Where Students Work in Pairs or Groups:

I UNDERSTAND:

1. Any and all university resources issued to me are for laboratory investigation and academic research use only.

2. I am financially responsible for the cost of all items issued to me.

3. Any costs will be shared equally among all students involved.

4. At the end of the semester, any and all costs will be billed to my University Account and any outstanding balance will result in a hold on my University Account.  This hold will prevent the registration, graduation and the receipt of transcripts.

5. I must return any resources issued to me by the Chemistry and Biochemistry Department complete, totally clean, unbroken and ready for future use.

6. I am responsible for the full cost of any university resource issued to me that is not returned, returned broken or dirty.

7. In the event of equipment theft or misuse, the party or person responsible will bear the full cost of replacement and be subjected to any and all disciplinary consequences deemed appropriate by the department and the university up to and including criminal prosecution.

8. Lost or broken items will only be replaced with department approved items through the stockroom.  Items purchased from alternative sources is strictly prohibited.  In addition to a $50 fee, the party or persons found replacing items purchased from alternative sources will be charged the full price of the missing or broken items.

9. Items returned less than 10 minutes prior to the scheduled end of lab will assessed a $20 late fee.

10. The department is not responsible for providing photographic evidence of items resulting in charges.

Section 2 – Lab Courses Where Students Work Individually:

I UNDERSTAND:

1. Any and all university resources issued to me are for laboratory investigation and academic research use only.
